David Ichel

David W. Ichel is a mediator, arbitrator and special master at X-Dispute LLC. He is appointed to the AAA (American Arbitration Association), CPR (International Institute for Conflict Prevention and Resolution), FedArb (Federal Arbitration, Inc.), USCIB-ICC and ARIAS-US panels. He is a Fellow of the Chartered Institute of Arbitrators (FCIArb).

Ichel was a long-time partner at Simpson Thacher & Bartlett LLP, where he practiced for 37 years, leading the defense and prosecution of complex commercial disputes and advising companies, boards and industry associations, in matters involving contract, commercial fraud, securities, product liability/mass tort, insurance coverage, insurance company insolvency, antitrust and unfair trade practice, distributor termination, defamation and advertising/labeling.

Ichel is also a senior lecturing fellow at Duke Law School (2011-present), where he teaches Complex Civil Litigation, focusing, as he does at the University of Miami, on taking students through large scale, multi-party, multi-forum litigation, including complaint filing and motions to dismiss; joint plaintiff and defense counsel groups; joinder of parties; class actions; federal-federal and federal-state multiple case forum disputes and MDL litigation; case management, discovery and document preservation; summary judgment; settlement of class actions and other complex litigation; alternative dispute resolution and complex trial approaches.

He is a Life Member of the American Law Institute (elected 1993), the Chair of the Editorial Board of Judicature (2018-present), the more-than-100-year-old journal for judges devoted to promoting best judicial practices and the rule of law. He is admitted to practice in NY, NJ, DC, the Supreme Court and numerous federal courts.

Ichel is the author of the following recent articles: “A New Guard at the Courthouse Door: Corporate Personal Jurisdiction After the Supreme Court’s Decision-Quartet,” 71 Rutgers Law Rev. 1 (2019); “Has Shoe Run Its Course: How will recent Supreme Court decisions on personal Jurisdiction impact the legacy of International Shoe and the future of Complex Litigation?,” 103-3 Judicature 64 (Spring 2019); and served as moderator/ editor for “A Bridge Too Far: The Promise and Peril of Third-Party Litigation Finance,” 103-2 Judicature 48 (Fall 2019).

He has served as a member of the Advisory Committee, moderator and panelist at the University of Miami Class Action & Complex Litigation Forum (2018, 2019 and 2020); and on the Faculty of the Duke Law - Bolch Judicial Center MDL Certificate program.

Ichel attended Duke Law School and was a staff editor on the Duke Law Journal; he also did his undergraduate studies at Duke, graduating summa cum laude and Phi Beta Kappa.

At Miami Law he teaches Large Scale Litigation - Practical Skills.
